Which vehicle can get to a specific location the fastest, taking into account the current traffic situation, or whether you can plan routes more economically in the future to avoid empty trips and fuel. GPS trackers for company cars bring transparency to your fleet. With GPS tracking, you always have the best overview of your fleet and can plan operations in a targeted and sustainable manner.
GPS monitoring of company cars also means that the employees who drive the vehicle are monitored at the same time - which is not entirely unproblematic in terms of labor and data protection law. In Germany, data protection is taken very seriously - and not just since the new GDPR in 2018 - and the recording and use of personal data is accordingly sensitive. When using GPS trackers in company cars, numerous requirements must therefore be met so that you as an employer do not act illegally.
GPS tracking of company cars: This is what the legislator says
The law leaves no room for doubt when it comes to employee monitoring: complete control is prohibited under the Federal Data Protection Act. Nevertheless, the use of GPS trackers in company cars may be permitted during working hours if the employees concerned have been informed of this measure with good reason because operational requirements make it necessary. Information must be provided about the purpose - i.e. why and how the employee is being monitored by GPS - and how the data is used and processed. This can include working time recording, time recording per location for automated billing, electronic logbooks, optimal tour planning, emergency dispatch of service and security staff, and much more.
Involvement of the works council necessary
Before GPS trackers are introduced in company cars, the works council, if one exists, must be informed so that a works agreement on GPS monitoring can be made if necessary. This legal provision sets out the circumstances under which movement data may be recorded, stored, processed and evaluated. If there is no works council, a written declaration of commitment by the employer or an addendum to the respective employment contract can be considered.
